Questions about expert reports in Valencia

Several of us bought in the same development. Can you report on every home?

Yes. Each home gets its own report with its own defects and valuation, and the visits are grouped to share the travel cost. Defects in common areas are dealt with separately, because the owners association claims them.

How long do I have to claim from the developer?

It depends on the type of defect. The LOE gives one year for finishes, three for habitability and ten for structural defects, from acceptance of the works, and two years to claim once the damage appears. It is best not to leave it late.

FAQ

Questions about claiming from the developer

Who is responsible for construction defects?

Each participant is liable for damage caused by their own errors: the designer for design faults, the contractor for workmanship, and technical site management for supervision and control. Where the cause cannot be attributed or fault is concurrent, all are jointly and severally liable. The developer is always liable to the buyer alongside the others. For that reason, contacting the developer is usually the simplest starting point for the owner.

Who claims for defects in communal areas?

The comunidad de propietarios, the owners' association, usually acts through a meeting resolution and its president. Façade, roof, structural, garage, pool or entrance defects affect everyone, and a joint claim with one expert report on communal areas is more effective. Each owner can claim defects in their home and, under case law, also communal-element defects affecting them directly. Keep individual flat issues clearly identified when documents are being assembled for a shared building claim.

Must I attempt a claim before going to court?

Since April 2025, Ley Orgánica 1/2025 generally requires an earlier attempt at a medio adecuado de solución de controversias, such as documented negotiation or mediation, before most civil claims can be filed. A burofax with the expert report and proposed solution is usually the first step: it records the date, can interrupt prescription if it meets the legal requirements and gives the other party an opportunity to repair. Your solicitor will explain the requirement applying to your case.

Are storm or DANA-related losses covered?

This depends on intensity and policy terms. Ordinary weather events, such as rainfall or wind exceeding certain thresholds, are usually covered by home insurance under its conditions. Extraordinary flooding and other extraordinary risks in Spain are covered by the Consorcio de Compensación de Seguros, the Spanish insurance compensation body, provided the property has insurance in force. Apply through the Consorcio and document damage carefully from the first day.

Can you act as experts in courts in other provinces?

Yes. An expert can act before any court in Spain. Our bases are Torrevieja, serving Alicante, Murcia, Valencia and Albacete, and Seville, serving western Andalusia. For other provinces, we assess travel for the inspection and trial. In some cases, ratification can take place by video conference if the court authorises it. Describe your case and we will advise on availability.
