A perito judicial is an expert witness with specialised technical knowledge who helps a judge understand matters such as the origin of a crack or the repair cost of faulty renovation work. They provide a written dictamen pericial, or expert report, and explain it at trial if called. The Ley de Enjuiciamiento Civil, Spain's civil procedure law, requires objectivity and a sworn or solemn declaration of truthfulness, whether a party instructs the expert or the court appoints them.
What is the deadline for claiming over hidden defects?
Article 1490 of the Código Civil, Spain's Civil Code, sets a very short deadline: six months from delivery of the home. Document the defect and consult a solicitor immediately rather than waiting. Other actions may have longer periods, such as contractual breach where delivery differs from the agreement, or the guarantees under the Ley de Ordenación de la Edificación (LOE), Spain's building law, for new homes. Your solicitor must assess the appropriate route.
What if the leak appears only when it rains?
This is a typical hidden-defect situation because a viewing in dry weather reveals nothing. Leaks after purchase may be claimed where there are signs that the problem already existed, such as repainted old stains or earlier roof repairs. Record every episode with photographs and dates, and arrange inspection promptly, preferably just after rainfall where possible, so that active moisture can be measured.
Who pays the expert's fees?
The person instructing a party-appointed expert pays their fees. If you win and the judgment orders the other party to pay costs, expert fees may form part of the costs payable to you, subject to statutory limits. A court-appointed expert usually requests a provisión de fondos, an advance towards fees, from the party who requested the appointment. The final allocation follows the judgment's decision on costs.
