Valencian LOTUP: works, uses and planning status
Last reviewed: 10 October 2026. This summary is for information only and is not legal advice; the only legally valid text is the one published in the official gazette.
What it regulates and who it affects
Decreto Legislativo 1/2021 approves the consolidated Ley de ordenación del territorio, urbanismo y paisaje de la Comunitat Valenciana, known as LOTUP (Valencian territorial, planning and landscape legislation). It governs planning and development activity in that territory. For homes, it matters for uses, works, authorisations and enforcement. Consult it alongside municipal planning rules and the plot’s records, rather than relying only on the postal address.
What you need to know
Land classification and zoning determine uses and works. A home physically existing or having utilities does not prove that every extension or use is authorised.
Municipal planning can establish protection, site coverage, setbacks and other conditions. A response relating to another plot or area cannot establish the viability of your project.
A licencia (licence) and declaración responsable (formal declaration of compliance) are different authorisation mechanisms, with different scope and requirements. Submitting a document does not legitimise every activity or replace additional authorisations where necessary.
The Registro de la Propiedad (Land Registry), Catastro (cadastre) and planning file have different functions. A construction appearing in one of them does not itself mean all works comply with planning rules.
For older works or situations of fuera de ordenación (a specific status of planning non-conformity), check the particular rules and restrictions. Do not promise legalisation because a generic number of years has elapsed.
Enforcement and time limits depend on the type of activity, dates, land and applicable rules. This factsheet does not give a universal period that makes an extension legal through age.
Application to a home
A terrace in a Torrevieja home has been enclosed, and the advertisement adds its area to the living room. Cross-check authorised plans, the Land Registry description, cadastral records and municipal documents. Physical measurement shows what exists, but does not determine whether the enclosure was permitted. If you intend to create openings or alter the façade, also examine protection and common elements. The purchase decision must consider restrictions on use and works alongside material costs.
An inspection can identify indications of changes from plans and suggest checking them. It should not certify planning legality without sufficient documentation or professional authority. The competent administration must clarify the file, and an authorised technician may need to assess compatibility. Keep workmanship defects, lack of authorisation and floor area discrepancies separate to request suitable documents and solutions.
Documents to cross-check
Request plans and authorisations for works, occupancy documentation or its equivalent, municipal communications and decisions. Gather a nota simple (Land Registry extract), cadastral data and extension records with established dates. For an enquiry, identify the plot and specific activity, rather than just the development’s name. Keep the complete response and its conditions, and check that it relates to the existing situation and intended use.
Key deadlines and figures
| What | Deadline or figure | Article |
|---|---|---|
| Territory | Comunitat Valenciana | Scope of the consolidated legislation |
| Works authorisation | According to activity and current legislation | Intervention rules |
| Age of an extension | Does not itself determine legality | Enforcement and specific rules |
Do not confuse the moment an issue appears with the deadline for bringing a legal action. Keep the documents establishing each milestone and use the table only for the situation it describes. Where a row refers to a contract or decision, consult that document: there is no universal figure that can replace it.
What to do if it affects you
- Identify the transaction and applicable law. Record the municipality, contract date, handover date and the parties’ status. Distinguish a purchase, a letting, maintenance work and a damages claim. This classification avoids applying a time limit from a different situation and allows you to seek legal advice with specific facts.
- Build a verifiable case file. Keep the original documents and make working copies. Organise photographs by date and room, retain complete messages and connect every payment to its purpose. If a document is missing, record your request for it; missing information must not be filled with assumptions about what happened.
- Describe the problem and its extent. Explain what you observed, where and since when, separately from what you believe caused it. Record any parts that could not be inspected and whether people or property are affected. Where there is a risk, prioritise protection and document the necessary measures before continuing the financial dispute.
- Communicate with a traceable record. Address your letter to the relevant person or organisation and retain evidence of its content, dispatch and receipt or attempted delivery. Identify the home, issue and attached documents. Request a specific response and distinguish asking for information, claiming damages and proposing negotiation: they may have different effects.
- Check the time limits with advice. Maintain a chronology of communications and actions, without assuming that a call, visit or promise to repair something extends the deadline. If court proceedings are being considered, seek advice on the prior negotiation requirement, its exceptions and effects on prescripción (limitation) or caducidad (expiry of an action). An administrative procedure does not automatically replace that step.
- Define a solution that can be checked. If repairs or a settlement are offered, specify the work, access, documents, acceptance and subsequent verification. Keep evidence of the previous condition and records of any intervention. Before signing a waiver, final settlement or acceptance without reservations, review its scope so you do not close issues that remain unresolved.
How an expert can help
An expert can provide a technical basis where the problem requires checking physical differences in layout or floor area and indications of interventions requiring documentary checks. The report must identify what was inspected, which documents were used and any limitations. Its conclusions must distinguish observations, sufficiently established causes and unresolved questions. A legal disagreement cannot be resolved simply by adding photographs, and an expert opinion does not replace the authorisation required for regulated certificates or designs.
Verify Home Inspector can consider an inspection or expert assessment within its specialism and the agreed scope. To discuss availability and work, you can request a quote. Before commissioning, clarify whether you need measurements, a financial assessment, a further visit or preparation for confirming the report in court, as these are different tasks and must not be assumed to be automatically included. See also the frequently asked questions on this topic to distinguish what the report contributes and what documents you should provide.
