Planning, buildings and energy: documents for your home
Last reviewed: 10 October 2026. This summary is for information only and is not legal advice; the only legally valid text is the one published in the official gazette.
A home’s condition cannot be summarised by one certificate. Building maintenance, planning status and energy rating answer different questions. This topic brings together the national framework and relevant Valencian, Andalusian and Seville rules for interpreting documents. Before buying or renovating, identify what you need to check and which administration or professional should answer.
To use this topic, start by identifying your position: owner, buyer, tenant or community representative. Then specify the problem and dates that may matter. The same property can be subject to different rules without all providing the same remedy. Maintenance, information, contracts and liability for damage must be analysed together, rather than as a single procedure.
A penthouse can have a current energy certificate and be in a building with a submitted ITE, yet include an enclosure awaiting planning clarification. Another property can be authorised and have a leak. Organise each document by purpose, territorial scope and date. Request the building’s outcome and outstanding actions, rather than just confirmation that a report exists. This lets you assess expenses and restrictions alongside the home’s physical condition.
Laws on this topic
Land Law: maintenance duties and building reports
Coordinate the maintenance duty with territorial rules. Part of the national IEE building assessment provisions was annulled. Review the report, actions and remedy without confusing them with a pre-purchase inspection. Read the factsheet on this law.
Decreto 53/2018: building assessment in Comunitat Valenciana
The IEEV.CV (Valencian building assessment report) covers residential building maintenance, accessibility and energy. It requires competent preparation and registration under the regional procedure. For a purchase, consult the outcome and outstanding works alongside your flat’s condition. Read the factsheet on this law.
Seville ITE: building inspection and outstanding works
Seville’s ITE (Inspección Técnica de Edificaciones, building inspection) has a municipal timetable and form. Submission does not mean every repair has been carried out. Consult the file and community actions when assessing a flat. Read the factsheet on this law.
RD 390/2021: energy certificates for sales and lettings
The energy certificate has its own purpose, registration and validity. Its label must appear in advertisements under the applicable rules. The rating does not replace defect checks or predict an exact bill. Read the factsheet on this law.
Valencian LOTUP: works, uses and planning status
Coordinate the Valencian LOTUP planning legislation with municipal plans and files. Land Registry records, cadastral information and physical reality establish different things. Before buying, clarify extensions, uses and restrictions through specific documents. Read the factsheet on this law.
Andalusia’s LISTA: homes, works and planning legality
The LISTA territorial and planning legislation organises Andalusia’s planning framework alongside its implementing rules and plans. Permissions, recognition and legalisation are not equivalent. Consult the status of extensions and uses through property-specific documents. Read the factsheet on this law.
Preparing your enquiry and organising action
Connect documents and facts. Prepare a brief chronology of relevant contracts, handovers, communications and interventions. If a community is involved, identify the affected element and existing resolutions. If a date is missing, say so expressly and explain which document should provide it; do not replace it with the date of your earliest retained message.
Distinguish technical and legal matters. A visit can describe damp, a measurement or incomplete work. Standing to claim, the claim procedure and the effects of a signature require reviewing legislation and documents. Prepare both matters to avoid losing time searching for evidence after choosing the action.
Request verifiable answers. When requesting information or action, specify the home, component and outstanding question. Asking for a missing document or a solution to an identified issue is more useful than asserting everything is wrong. Keep complete responses, including reservations or conditions accompanying a proposal.
Review how the matter closes. A repair, payment or certificate delivery does not necessarily resolve every open question. Check which obligations have been fulfilled and which actions remain outstanding. If an agreement is proposed, distinguish technical acceptance, financial compensation and legal waiver before signing general acceptance.
Do not use a visit, telephone enquiry or waiting for a response as a substitute for checking deadlines. Where there is a dispute, the strategy must address evidence, preservation of the property and procedure. Urgent measures to prevent damage may be needed before that strategy is finalised; documenting them lets you explain afterwards why action was taken and what was preserved.
The factsheets help locate legislation and its main aspects. To resolve a specific situation, the contract, territorial rules, works date and legislative changes may also matter. Consult the official text and retain copies of the documents used, particularly if a party bases its response on an older version of the legislation.
