What to do if you discover a possible hidden defect

Last reviewed: 10 October 2026.

Quick answer

If a possible vicio oculto (hidden defect under Spanish civil law) appears after buying, protect people and prevent damage increasing; then keep photographs, dates and documents before altering the area. Notify the seller with evidence of the content and immediately seek advice on the route and deadline. The Código Civil’s saneamiento actions last six months from delivery; do not wait for the report to review how to act.

First actions: safety, protection and initial records

A hidden defect is a possible legal classification, rather than a conclusion to write on seeing the first stain. Start by describing what happened: where it appears, when you observed it and which use it prevents. If water is near electricity, elements are loose or there are instability indications, avoid the area and request appropriate intervention. You do not need to preserve active damage at the cost of increasing a risk.

Take reasonable protective measures, such as stopping a leak with safe help or moving belongings from an affected area. Record before and after where possible. If immediate intervention is needed, ask the professional to describe findings, removed items and why. Urgency justifies action, but it must be explainable through documents rather than only an invoice saying ‘repair’.

Recording the first episode

  • Observation date and time, room and exact position.
  • Symptom: water entry, stain, smell, breakage, lost function or deformation.
  • Known conditions: rain, appliance use or recent intervention, distinguished from hypotheses.
  • Overview and detail photographs, without filters or crops replacing the original.
  • Urgent measures and person performing them, with available supporting documents.
  • Communications to seller, community or insurer according to the possible scope of damage.

Keep original files and a copy to share. A photograph does not itself establish the defect’s age, but provides condition and context if well identified. Do not change its date or add information to the original file to strengthen an explanation. You can create a separate record with notes and references.

If another home or common element is affected, notify the relevant people and coordinate access. Cooperation allows examination of both sides of the damage and collection of history. Do not automatically blame the upstairs neighbour. A roof, soil stack or private installation may be involved, and the first task is preventing harm and locating the source.

At the end of the first day, prepare a basic purchase and damage chronology and missing document list. You can then seek advice immediately without waiting for a perfect file.

Reconstruct pre-existence, visibility and impact without exaggeration

For saneamiento (the seller’s statutory liability for defects) under article 1484 of the Código Civil (Spanish Civil Code), a relevant, concealed defect existing at the time of sale matters, with the other applicable conditions. Discovering it later does not demonstrate every requirement. A new failure may have a later cause, and a pre-existing issue may have been known or visible. The assessment must answer each question with different evidence.

Which evidence helps each question

For existence and impact, document the component, extent and what it prevents. For source and age, gather construction details, materials, intervention history and development. For visibility during purchase, keep viewing photographs, the advertisement, furniture or coverings restricting access and answers received. Do not present partially inferable matters as certainty.

The causal link connects the defect studied with the damage. An old pipe near a stain does not prove it is the source. Route checks, access or specific authorised tests may be needed. The report must explain alternatives considered, supporting data and limitations. If an exact date cannot be determined, an estimate must be justified without inventing it.

Severity is not measured only by cost. A problem can affect a room’s use, safety or contracted performance. Describe frequency, area, duration and consequences. Separate inconvenience, wear and relevant damage. An expensive repair chosen for cosmetic preference does not turn a minor defect into a serious one.

The seller’s knowledge requires other indications: communications, previous repairs or minutes in which they participated can matter, but do not always demonstrate what they knew and when. Recent painting can have many reasons. Avoid alleging deliberate concealment without a basis; request specific history and keep the response.

Your initial aim is not to win an argument through a label, but to gather enough information for the expert and lawyer to distinguish confirmed facts, hypotheses and outstanding legal requirements.

Prepare purchase documents and preserve evidence

Gather the private contract, arras, deed, attachments, possession handover and transaction messages. Identify the physical delivery date, which may require documents other than the deed. Add the advertisement, specification or specific promises where they existed. If there are exemption clauses or a sale como cuerpo cierto (of the property as a specified whole), give the adviser their complete text; do not assume they remove every right or are irrelevant.

Earlier photographs may show a visible area, repair or covering. Keep who supplied them and their context. If the community has leak minutes, request relevant documents through its representative. A neighbour’s conversation can guide the search, but distinguish testimony, documents and your own deductions. Do not turn memories into an established date.

Folder order

  1. Purchase: contracts, advertisement and delivery documents.
  2. Previous condition: viewing photographs and seller responses.
  3. Current damage: episodes, measurements and location.
  4. Interventions: quotations, urgent works and retained components.
  5. Communications: requests, responses and receipt evidence.
  6. Report and advice: final versions and documents provided to them.

When sharing messages, supply the complete relevant conversation and attachments. A selected screenshot can omit conditions or responses changing its meaning. Keep originals and prepare an organised copy; if authenticity is disputed, a specific preservation or evidential method may be needed. Do not publish the seller’s personal details to apply pressure: use the file with authorised participants.

Before removing material, consider technical inspection, dismantling photographs and retention of samples or components. Define what is kept, where it comes from and how it is identified. Do not store dangerous material at home to preserve evidence. Coordinate safety and procedure with suitable professionals.

If a company repairs the damage, request the discovered cause, work and quantities. An invoice establishes a transaction, but does not always explain previous condition or necessary cost. Documenting intervention connects it to damage and separates repair, temporary protection and improvement. That distinction helps negotiation and quantification.

Communicate in writing and coordinate prior negotiation

The communication must identify the home, contract, observed defect, date and request. If a report exists, attach it or indicate availability according to strategy. Keep the content and evidence of dispatch or attempt, rather than only proof that an envelope was sent. If causes remain unassessed, say so expressly and request access or history; an honest description is more useful than an unsupported technical accusation.

Practical contents of the formal request

State what you detected and where, urgent measures taken and accompanying documents. Explain the requested solution or proposed assessment without confusing reservation of rights with an unsubstantiated sum. Request a response and visit coordination where appropriate. Legal wording must match the action and deadline, particularly if prior negotiation is required.

Since April 2025, Ley Orgánica 1/2025 (Spanish legislation on justice efficiency) generally requires a medio adecuado de solución de controversias (MASC, appropriate dispute resolution method) before many civil claims, subject to exceptions. An ordinary complaint and a negotiation request with a defined subject are not necessarily the same. Article 7 governs effects on prescripción (limitation) and caducidad (expiry) when requirements are met. Seek advice on documenting commencement, communications and conclusion.

Do not treat any burofax (a service providing evidence of dispatch and content) as automatically extending the saneamiento period. The medium can establish communication, but its effect depends on content and rules. While negotiating, the adviser must monitor calculation and necessary action. A report in preparation or seller-proposed visit does not replace that check.

If the other party offers an inspection, coordinate access, safety and recording of condition. It may be reasonable to allow examination before a non-urgent repair without accepting every solution in advance. Keep people, dates and works listed, and retain agreed documents.

Also distinguish pre-existing technical evidence from confidential negotiation material. Do not publish proposals or conversations or indiscriminately include them in a claim; the lawyer must review what can be used and how to establish the attempt. The technical file can remain organised without turning every settlement offer into proof of admitted liability.

Six months from delivery and other routes requiring assessment

Article 1490 establishes six months from delivery for the saneamiento actions it covers. This requires prompt action, even if damage appears near the period’s end. Do not count from the report, first repair or seller response date. If delivery is uncertain, gather documents and seek advice immediately.

Expiry and limitation have different effects. Generally, you cannot apply the same interruption rules to every action. Regulated negotiation can suspend expiry in situations under article 7 of Ley Orgánica 1/2025; its effectiveness and resumption must be reviewed with documents. Avoid homemade calculations adding another complete period after any message.

The acción redhibitoria (action to unwind the sale) seeks to set aside the sale with statutory restitutions; the acción estimatoria (action for a proportional price reduction) allows a proportional reduction. They are not simply repair or compensation chosen without consequences. Article 1486 links damages under its second paragraph, where the seller knew and did not disclose the defect, to opting for rescission. Other compensation grounds need specific analysis.

An unfulfilled contractual obligation may provide a different route if its requirements are met. Personal actions without a special period have the general five-year rule from enforceability under article 1964, with qualifications. For works within the LOE (Ley de Ordenación de la Edificación, Spanish Building Law), damage periods are one, three and ten years, and actions have a two-year limitation period from damage occurring. Do not simply choose the longest figure.

Known or visible damage may fall outside saneamiento, although other obligations or promises may exist. A failed later repair can generate additional facts without automatically making the entire matter a new action. The adviser must distinguish subject, parties, cause and date of each claim.

Consult the saneamiento factsheet and limitation factsheet to prepare questions. These pages provide guidance, rather than determining your case’s deadline. Coordinate legal action and expert assessment from the first episode, postponing only information that cannot be obtained immediately.

Repair, valuation and agreement: closing precisely

If repair is proposed, request treatment of the cause and reinstatement of consequences, with access and verification. A leak may require work on the roof or in another home; a quotation limited to your painting may be insufficient. Define what will happen and what depends on authorisation, without accepting that a quick intervention explains the whole defect.

The technical valuation must describe quantities, the solution and price references. Do not automatically equate repair cost with proportional price reduction. They can be related, but the action and financial subject require assessment. Separate belongings damage, necessary works, outstanding maintenance and improvements now chosen. Avoid adding several offers containing the same items.

Following up a solution

  • Retain the issue number and record previous condition.
  • Keep the accepted quotation and changes during work.
  • Document removal and discovered components where safe.
  • Request operation and finish checks according to the solution.
  • Record what needs drying or subsequent monitoring.
  • Review agreement scope and any waiver before signing.

If the seller proposes paying a sum, clarify whether it is on account, closes one item or settles everything. Do not infer scope from a transfer reference. Give documents to the adviser to review effects. With several defects, one may be resolved while another remains outstanding; wording must reflect this.

Before hiring another company, coordinate appropriate evidence and formal requests, except for urgent measures. Keep invoices, measurements and actual works. A paid cost is not itself recoverable: relate it to necessity, cause and claim rules. Explaining why the intervention was chosen where alternatives existed also matters.

The final file must reconstruct purchase, appearance, assessment, communication, repair and result. If a technical conclusion changes after opening, keep versions and the reason. That update strengthens transparency: discovering new information does not justify retaining an unsupported hypothesis. Your claim is more precise when recognising limitations and avoiding presenting preferences as damage.

Common mistakes

  • Waiting for the report before seeking deadline advice. Calculation may have started at delivery. Coordinate immediate advice and technical work; an outstanding visit does not itself preserve the action.

  • Repairing everything without previous-condition records. Document beforehand where possible and record dismantling discoveries. Attend emergencies without exposing yourself to risk and keep an explanation of necessary action.

  • Calling every recent paint job concealment. Request history and assess cause and visibility. Distinguish indication, inference and established information to avoid unsupported accusations.

  • Sending a message and assuming another full period. Check action, recipient, content and effects. MASC, limitation and expiry have different requirements.

  • Claiming improvements as repairs. Define the performance to restore and necessary items. A kitchen chosen for taste does not equal the damage behind the claim.

  • Signing compensation without reading its scope. Clarify covered items and rights, and what remains outstanding. Keep attachments and verification status.

When you need an expert

Expert assessment is useful when studying existence, prior origin, impact and whether the defect could be detected when buying. The professional must justify conclusions through observations and documents, identifying what cannot be dated or checked. A technical opinion does not guarantee every action requirement is met or replace deciding legal strategy.

Verify Home Inspector offers possible hidden defect assessments to examine technical matters that may support a claim. The scope of its expert reports must specify subject, documents, access and valuation where appropriate. When requesting a quote, give municipality, delivery date, appearance date and repairs undertaken. Attach the contract, original photographs and seller communications; the hidden defect frequently asked questions help organise that history without postponing legal deadline advice.

Frequently asked questions

What if the damage disappears for a few days?

Record each episode and known conditions without assuming repair. Water penetration can depend on rain or use, and a stain can dry while its cause remains. Keep original photographs and history and ask when inspection is appropriate. Absence of symptoms during a visit must appear as an examination condition, rather than proof they never existed.

Can a document contradicting my first explanation help?

Yes. Provide that document to the expert and lawyer too. It can change a hypothesis about cause, date or responsibility and avoid a poorly framed claim. Do not select only favourable messages: a transparent conclusion must consider alternatives. Keep the original and explain its source for assessment alongside other facts.

How do I record an urgent repair if the expert could not attend?

Ask the repairer to describe condition, discovered cause, intervention and removed materials, with photographs where safe. Keep the invoice and urgency communications. State what could not be documented and why. Later information can support assessment, but should not be presented as if the expert personally saw every layer before intervention.

What if the seller and community offer different solutions?

Separate maintaining the element from claiming against the appropriate party. Coordinate access and documents so each proposal addresses the cause and consequences. Do not sign incompatible agreements or assign liability solely by who offers payment first. The adviser must review parties and scope while the technical assessment compares what each intervention would resolve.

Has a defect appeared after buying?

The deadline to claim against the seller for hidden defects is six months from handover. We will tell you whether the case has technical merit.
